If a man who has been with a woman for a long time and has a physical relationship with her refuses to marry her, does he really have any responsibility? Does a woman get a share in alimony and wealth like a wife? Can this relationship be considered as a marriage? The Supreme Court is now gearing up for such a question. The court has sought suggestions from the central government in the matter.
Sumit Kumar / New Delhi: If a man who has been with a woman for a long time and has a physical relationship with her refuses to marry her, does he really have any responsibility? Does a woman get a share in alimony and wealth like a wife? Can this relationship be considered as a marriage? The Supreme Court is now gearing up for such a question. The court has sought suggestions from the central government in the matter.
Amix Curie Appointment
A bench headed by Justices Adarsh Kumar Goyal and Abdul Nazir asked the Center whether such a long-lasting relationship could be considered as a marriage. What should a relationship be like to be married? How long can a relationship last? The court has appointed senior counsel Abhishek Manu Singhvi as amicus curiae to help in the matter. The court also asked Attorney General KK Venugopal to appoint a law officer to assist the court in the matter.
What is the whole matter?
Alok Kumar of Bengaluru has filed an application in the Supreme Court seeking acquittal of other charges, including misdemeanor charges against him. The Karnataka High Court had dismissed the petition seeking dismissal of other charges, including misconduct against the petitioner. The woman's mother had lodged a complaint against the petitioner. According to the petitioner, these allegations do not arise. Because voluntarily we both lived together and consensually formed a physical relationship between the two. Now the Supreme Court has stayed the ongoing case against the petitioner.
Protected by live-in relationship law
Women living in a live-in relationship are properly contracted for maintenance, including a share in property, covered under domestic violence. An adult male can live together even without marriage. The apex court had said this in connection with the case of a 20-year-old woman living in Kerala. A woman has the right to be with whomever she wants. The court also said that the court has now also recognized the live-in relationship.
