In the matter of regularization of unauthorized occupation of lands under the Bombay Merged Territories (Baroda Watan Abolition) Act, 1954.

પ્રસ્તાવના :-

નિયત સમયમર્યાદામાં નિયત કરેલ કબજાકિંમત ભરાવીને રીગ્રાન્ટ કરી કબજેદારોને માલીકી હક્ક આપવામાં આવેલ હતા. આવા કબજેદારો મોટા ભાગના ખેડૂતો અભણ, નાના અને સીમાંત ખેડૂત હોઇ માત્ર ખેતી કરીને રોજગાર મેળવતા હોઇ તેમજ કાયદાની અજ્ઞાનતાના લીધે ઇનામ નાબૂદી કાયદાની નિયત સમયમર્યાદામાં આવી કબજા કિંમત ભરી શકેલ નથી. આ કાયદાની જોગવાઇઓમાં આવા કબજા હક્ક ની રકમ ન ભરનાર સંક્ષિપ્ત હકાલપટ્ટીને પાત્ર થાય છે અને આ જમીનો સરકારી જમીન તરીકે નિકાલને પાત્ર બને છે, પરંતુ જે તે વખતે આવી કાર્યવાહી થયેલ છે અથવા થયેલ નથી. જમીન પરનો આ પ્રત્યક્ષ કબજો આજદિન સુધી કબજેદારો અથવા તેના વારસદારોનો ચાલી આવેલ છે અથવા તો તેઓ આ જમીન કબ કિંમતની રકમ ભર્યા વિના સ્વત્વાર્પણ વેચાણ) કરેલ છે. આ કાયદો રીપીલ એક્ટ-૨૦૦૦ થી રજૂ થયેલ હોઇ, હવે આવા કબજા કિંમત ભર્યા વિનાના અનઅધિકૃત કબજેદારોને સંક્ષિપ્ત હકાલપટ્ટી કરીને દૂર કરી શકાય તેમ નથી. તેમજ આવી કબજા કિંમત ભરવાની નિયત સમય મર્યાદા પણ વધારી શકાય તેમ નથી. 

આ જમીનો પરત્વેના તેઓના અનધિકૃત કબજા નિયમબધ્ધ કરવાની બાબત રાજ્ય સરકારની ક્રિયા વિચારણા હેઠળ હતી.

Introduction :-

 Ownership rights were given to the occupiers by re-grant on payment of the prescribed possession price within the stipulated time frame. Such occupiers are mostly illiterate, small and marginal cultivators who earn employment only by farming and due to ignorance of the law they are unable to pay such possession price within the stipulated time frame of the Abolition of Inam Act. Non-payment of such possession dues is subject to summary eviction under the provisions of this Act and such lands are liable to be disposed of as Government land, whether or not such action has been taken at that time. This direct possession of the land has continued till date with the occupants or their heirs or else they have sold the land without paying the price. Since this law was introduced by the Repeal Act-2000, such possession cannot now be removed by summary eviction of unauthorized occupiers without paying price. Also the fixed time limit for payment of such possession price cannot be extended.

 The action of the state government to regularize their unauthorized possession of these lands was under consideration.
