Matter of regulation of German unauthorized occupation under the Bombay Junior Village Watan (Village Nakar Government Useful) Abolition Act-1958 Act.

પ્રસ્તાવના :-

ધી મુંબઈ કનિષ્ઠ ગામ વતન(ગામ નોકર સરકાર ઉપયોગી) નાબુદી એકટ-૧૯૫૮ કાયદાના અમલ દરમ્યાન નિયત સમયમર્યાદામાં નિયત કરેલ કબજાકિંમત ભરાવીને રીગ્રાન્ટ કરી કબજેદારોને માલીકીહક્ક આપવામાં આવેલ હતા. આવા કબજેદારો મોટા ભાગના ખેડૂતો અભણ ,નાના અને સીમાંત ખેડૂત હોઇ માત્ર ખેતી કરીને રોજગાર મેળવતા હોઇ તેમજ કાયદાની અજ્ઞાનતાના લીધે ઇનામ નાબૂદી કાયદાની નિયત સમયમર્યાદામાં આવી કબજાકિંમત ભરી શકેલ નથી.આ કાયદાની જોગવાઇઓમાં આવા કબજાહક્ક ની રકમ ન ભરનાર સંક્ષિપ્ત હકાલપટ્ટીને પાત્ર થાય છે અને આ જમીનો સરકારી જમીન તરીકે નિકાલને પાત્ર બને છે, પરંતુ જે તે વખતે આવી કાર્યવાહી થયેલ છે અથવા થયેલ નથી, જમીન પરનો આ પ્રત્યક્ષ કબજો આજદિન સુધી કબજેદારો અથવા તેના વારસદારોનો ચાલી આવેલ છે અથવા તો તેઓ આ જમીન કબજાકિંમતની રકમ ભર્યા વિના સ્વત્વાર્પણ(વેચાણ) કરેલ છે. આ કાયદો રીપીલ એક્ટ-૨૦૦૦ થી રદ્દ થયેલ હોઇ હવે આવા કબજાકિંમત ભર્યા વિનાના અનઅધિકૃત કબજેદારીને સંક્ષિપ્ત હકાલપટ્ટી કરીને દૂર કરી શકાય તેમ નથી. તેમજ આવી કબજાકિંમત ભરવાની નિયત સમયમર્યાદા પણ વધારી શકાય તેમ નથી. આ જમીનો પરત્વેના તેઓના અનધિકૃત કબજા નિયમબધ્ધ કરવાની બાબત રાજ્ય સરકારની સક્રિય વિચારણા હેઠળ હતી.

Introduction :- During the implementation of the Mumbai Junior Village Watan (Village Servant Government Useful) Abolition Act-1958, the ownership rights were given to the occupants by re-grant by paying the fixed possession price within the stipulated time frame. Such occupiers are mostly illiterate, small and marginal cultivators who earn employment only through cultivation and due to ignorance of the law, have not been able to pay such possession price within the stipulated time limit of the Abolition of Inam Act. The provisions of this Act make those who do not pay such possession price liable to summary eviction and these lands. becomes subject to disposal as Government land, but which such action has or has not been done at that time, the direct possession of the land has continued to the present day of the occupants or their heirs or they have alienated (sold) the land without paying the possession price. This Act being repealed by the Repeal Act-2000, such unauthorized occupiers without payment of possession price cannot now be removed by summary eviction. Also the fixed time limit for payment of such possession price cannot be extended. The matter of returning these lands and regularizing their unauthorized occupation was under active consideration of the state government.

ઠરાવ :-

કાળજીપૂર્વકની પુખ્ત વિચારણાને અંતે ધી મુંબઈ કનિષ્ઠ ગામ વતન(ગામ નોકર સરકાર ઉપયોગી) નાબૂદી એકટ-૧૯૫૮ હેઠળના કબજંદારોના અધિકૃત કબજા નિયમબધ્ધ કરવા નીચે મુજબ ઠરાવવામાં આવે છે.

Resolution :- After careful consideration, it is decided as follows to regulate the authorized possession of squatters under The Mumbai Junior Village Watan (Village Servant Government Useful) Abolition Act-1958.

રીગ્રાન્ટ કરેલ જમીનની કબજાકિંમત નિયતસમયમાં ભરપાઇ ન કરનાર કબજેદાર અથવા તેમના વારસદારો જો આવા અનધિકૃત ધારણ કરનાર હોઇ અથવા કબજાહક્કની રકમ ભર્યા સિવાય જે જમીનોની તબદીલીઓ થઈ ગયેલ હોઇ અને હાલ આવી જમીનો અન્ય ઇસમના કબ્જામાં હોય તેવા હાલના કબ્જેદારો પાસેથી પ્રવર્તમાન જંત્રી કિંમતની ૨૦% કબજાહક્કની રકમ વસૂલી આવા અનઅધિકૃત કબજા નિયમબધ્ધ કરી આપવાના રહેશે.

The occupiers who fail to pay the possession price of the re-granted land or their heirs if they are such unauthorized occupiers or other than paying the possession amount, collect the amount of 20% of the existing jantri value from the existing occupiers of the lands which have been transferred and are currently in possession of such lands in other names. Unauthorized possession should be regularized.

ઉપર મુજબ નિયમબધ્ધ કરેલી જમીનો જે તે કબજેદાર આ જમીનો નિયમિત થયા તારીખથી ખેતીના હેતુ માટે જુની શરતે ધારણ કરશે, પરંતુ જમીનની તબદીલીહેતુફેરના કિસ્સામાં વંચાણે લીધેલ ક્રમાંક-(૪) સામે દર્શાવેલ ઠરાવની જોગવાઇ અનુસાર પ્રિમીયમ પાત્ર થશે તથા આ બાબતે સરકારશ્રીની વખતો વખતની સૂચનાઓને ધ્યાને લેવાની રહેશે.

The lands regularized as above which the occupier shall hold for the purpose of agriculture from the date of regularization, but in case of transfer of land for purpose shall be eligible for premium in accordance with the provisions of the resolution mentioned against No. (4) read and the instructions of the Government from time to time shall be observed in this regard. 

તા: ૦૮/૦૧/૮૦ ના ઠરાવ ક્રમાંક :- દબણ-૧૦૭૨-૨૮૭૬૫-લ ના ફકરા-૬(૨)માં દર્શાવેલ ૮(આઠ) એકરની મર્યાદા આવી જમીનોના કબજા નિયમબધ્ધકરવાના કેસમાં લાગુ પાડવાની રહેશે નહિ, પરંતુ આ જમીનોમાં ગુજરાત ખેત જમીનો ટોચ મર્યાદા અધિનિયમ-૧૯૬૦ અને તેમાં થયેલ વખતોવખતના સુધારાની જોગવાઇ લાગુ પાડવાની રહેશે.

Dated: 08/01/80 Resolution No. :- The limit of 8 (eight) acres mentioned in paragraph-6(2) of Daban-1072-28765-L shall not be applicable in the case of regularization of possession of such lands, but in these lands Gujarat farm The provisions of the Land Ceiling Act-1960 and its amendments from time to time shall be applicable.

આવા અનધિકૃત કબજા નિયમબધ્ધ કરવાની સંપૂર્ણ સત્તા બાથી કલેક્ટરશ્રીની રહેશે.

The Bathi Collector shall have full authority to regulate such unauthorized possession.

ઉક્ત ઠરાવ હેઠળની જમીનો પરત્વે સરકારપક્ષે દાખલ કરવામાં આવેલ પીટીશન/અપીલો આ ઠરાવ અમલમાં આવ્યેથી વિથડ્રો કરવાની રહેશે અને ઉક્ત ઠરાવ મુજબ તમામ કલેક્ટરશ્રીઓએ સદરહું જમીનો નિયમબધ્ધ કરવાની રહેશે.

The petitions/appeals filed by the Government for the return of the lands under the said resolution shall be withdrawn after the implementation of this resolution and all the Collectors shall have to regularize the lands as per the said resolution.
